The Ministry of Culture is responsible the development of the cultural identity of the Karno-Ruthenian Empire and is the head for the development of cultural activities, as well as the promotion of our cultural identity within the Empire as much as abroad.

THE KINGDOMS AND LANDS OF THE CROWN OF RUTHENIA AND THE LANDS REPRESENTED IN THE COUNCIL OF KARNIA
HIS IMPERIAL AND ROYAL MAJESTY’S MINISTRY OF CULTURE OFFICE
A ministerial decree to dispose about the kulturhaus of the State.

His Excellency, the Minister of Culture, in exercise of the powers confered on him, thinks it desirable to make this Order for the purpose of declaring, in full harmony with the Imperial Constitution, the creation of an imperial kulturhaus, decreed the following:

TITLE I
GENERAL DISPOSTIONS

ARTICLE 1º An imperial kulturhaus is by means of this order created and named Lichthaus.

§ 1º The Lichthaus has as its objectives:
I – the promotion and preservation of traditional Karno-Ruthenian culture and art as national heritage and substance of national identity;
II – the publication and preservation of Karno-Ruthenian works of art and literature;
III – the maintaining of an imperial library and an imperial gallery open to public access.

§ 2º The Lichthaus is bonded to the Ministry of Culture.

§ 3º The said institution takes place at the Oranjeplatz of the Citadel.

TITLE II
ADMINISTRATION

ARTICLE 2º The Ministry of Culture is responsible for administrating the kulturhaus and shall compose its management board once promulgated this order.

ARTICLE 3º The Ministry of Culture may appoint a new management board at any time, at its will, by means of ministerial order, if the appointed citizens shall accept assuming such a role, even if the management board in effect has not asked for resignation, in accordance with article 4.

§ 1º The management board in effect may request resignation at any time by official communication with the Ministry of Culture, continuing to fulfill its duties until the new management board is determined to the maximum term of one month.

§ 2º If in the term of one month from the resignation request the Ministry of Culture has not appointed a new management board, it will once again assume its function.

ARTICLE 4º The competences of the Minstry of Culture regarding the Lichthaus are:
I – to represent the Lichthaus in any official matters;
II – to ensure the fulfillment of the objetives stipulated in article 1 §1º by supervising the management board or exercising its function;
III – to appoint a new management board when the one in effect requests resignation or fails to comply with its competences, named in article 5.

ARTICLE 5º The number of members of which the management board will consist is to be determined by the Ministry of Culture in the time of its appointment according to need.

ARTICLE 6º The competences of the management board are:
I – to comply with article 1 § 1 of this order by providing public access in the kulturhaus’ facilities to:
a) national works of art and literature;
b) eminent global intellectual works.
II – to look after the Lichthaus’ collection by preserving its works and managing its sections and subsections, creating new ones if necessary, aiming for the optimal accessibility of the said collection;
III – to receive, assess and expose contributions to the collection in conformity with the the process described in title III of this article;
IV – to exclude from the collection any work that comes to be accepted in spite of the process above mentioned;
V – to respect the authoral rights of the contributors as designated in title IV of this order;
VI – to request permission to the Ministry of Culture before executing any course of action which is not provided in this order;
VII – to respect the resignation process described in article 3 of this order.

TITLE III
SUBMISSIONS

ARTICLE 6º The Lichthaus’ collection is opened to contributions of every Karno-Ruthenian citizen, provided he undertakes the ordinary process of submission in this title described.

ARTICLE 7º The refered contributions may happen in the form of:
I – Authoral works of plastic arts in digital format, including painting, sculpture, photography, engraving, illustrations of any kind etc;
II – Works of plastic arts of public domain in digital format;
III – Authoral works of literature;
IV – Authoral musical works in digital sheet format;
V – Books in digital format.

ARTICLE 8º The citizen who wishes to contribute with his work to the collection of the kulturhaus shall submit it via official means determined by the management board and informed in the Lichthaus’ facilities, along with a signed term of consent in the same place provided.

SINGLE PARAGRAPH. Once the work and term of consent received, the management board will inform the contributor the time he shall wait for a response and proceed to the assessment of the submitted work.

ARTICLE 9º The criteria for assessment of the submitted works are the following:
I – Authentic work, not originated from illegal copy or falsification;
II – Conformity with the possible contributions specified in article 7º of this order;
III – Artistic quality in form and content, meaning works seriously lacking technique or of imoral content will be rejected.
IV – Potential to promote and preserve Karno-Ruthenian culture and intellectual life as substance of national identity.

ARTICLE 10 The management board’s response is unappealable in administrative instance.

ARTICLE 11 Given the affirmative response to the contribution, the management board will inform the contributor of the maximum time period it will take to include the work in the Lichthaus’ collection and proceed to inclusion.

ARTICLE 12
Any infraction of the deadlines described in this title by the management board may be reported to the Ministry of Culture, which shall proceed as it judges fit.

TITLE IV
COPYRIGHTS

ARTICLE 13 The Lichthaus has the duty respect the copyrights to any work hosted by it.

ARTICLE 14 The submission of works to the Lichthaus does not imply in copyrights cession.

§ 1º The citizen who submits his work to the Lichthaus gives it permission to keep it under exhibition until its withdrawal is requested by official means of communication or until it is excluded from the collection by determination of the management board.

§ 2º The owner of the rights of a hosted work may request its withdrawal at any time through the official means of communication exposed in the Lichthaus facilities. The management board shall withdraw the work in a due time of 15 days.

ARTICLE 15 By submitting any work the contributor assumes full responsibility for its authorship, if it is not a work of public domain, under the terms of the law.

ARTICLE 16 In case of identification of spurious authorship of a hosted work and presented the due evidences, the work in question will be immediately withdrawn from the collection.

§ 1º The referred evidence must consist of:
I – official intellectual property registration;
II – record of any kind that proves the possession of the work by another author in prior time than that of the spurious author.

§ 2º In the case described in the item II of the previous paragraph, the work will be temporarily withdrawn from the collection and the accused author informed. He may then manifest himself with proof of the contrary. The management board shall judge if the work can be securely made available again or if it will require the official intellectual property registration before that can be done.

§ 3º If the work in question is proved to be of public domain, the same work will be maintained in the collection, with the corrected authorship.

§ 4º If there is no manifestation of the rightful author, the same work will be excluded from the collection.

§ 5º The testified spurious author is irreversibly impeded from submitting works to the Lichthaus.

§ 6º The rightful author of a work previously excluded by the process described in this article may submit the work again at any time, if so he desires, through the ordinary process of submission.

TITLE V
FINAL DISPOSITIONS

ARTICLE 17 The Lichthaus is initially composed of:
I – The Karno-Ruthenian Art Gallery, dedicated to works described in item I of article 7º of this order;
II – The Imperial Art Gallery, dedicated to works described in item II of article 7º of this order;
III – The Karno-Ruthenian Library, dedicated to works described in items III and IV of article 7º of this order;
IV – The Imperial Library, dedicated to works described in item V of article 7º of this order.

ARTICLE 18 The Lichthaus is not responsible for the existential subsistence of the hosted works.

ARTICLE 19 The Lichthaus can only be temporarily closed by the Ministry of Culture or determination of law and permanently closed by:
I – proposal from the Ministry of Culture and acceptance of His Majesty the Emperor;
II – direct demand of His Majesty the Emperor;
III – Any other form if so described by law.

I ordain all authorities to whom the knowledge and execution of the present Ministerial Order belong, to comply with, and enforce and obey its contents as fully as it is contained.
